TERMS, RULES & CONDITIONS OF USE
Customtrip.org is owned and operated by Silviya Topchiyska and operates as a sole proprietorship, also known in this document as “the SP”. The SP is registered in Nantucket, MA and follows all state regulations on conducting business. The State of Massachusetts does not charge sales tax on digital services. For more information please visit the Massachusetts Department of Revenue website. Every invoice and all formal documents you receive will be issued by Silviya Topchiyska and “CustomTrip” will be added to a separate line but not as part of the business entity.
CustomTrip.org does not operate on the basis of a travel agency and does not have travel agents. We consider our services as “travel consulting” and “trip planners”, where we can give you “Tips&Tricks” for more effective and enjoyable traveling (category on our website www.customtrip.org), and plan in detail your trip(s). We plan trips for groups and/or individuals. We do not initiate or make bookings on behalf of customers. We do not give our clients’ personal information to booking sites, airlines, accommodations, etc UNLESS the client has allowed us to do so in writing. We simply do the research for you, plan everything out and ask for the payment (you can read more about it below). Once payment is received we send you your travel plans/trip plans along with recommendations where to stay, what to visit, where to purchase your flight tickets, etc. and if you so choose to use one of the recommended by us links, all calculated according to your stated budget (there is a specific question for that in our ‘contact form’). We only collect credit card details IF the client has previously authorized us to do so in writing. We provide 24/7 logistics support during your travels. The logistics support is discussed between a representative from CustomTrip and you (the “Traveller”) ahead of time. Custom Trip is not responsible if “Travellers”, traveling according to our planned trips, get lost, lose personal items, get hurt or any other harm and/or danger happens to them before, during and/or after the trip.
SCOPE OF SERVICES
Customtrip.org provides travel planning services. We ask, through our “contact form” what kind of trip you (“The Traveler”) would like to embark on. We ask for specific dates of departure, arrival, and return, as well as location(s). We collect basic personally identifying information such as your name, email address, physical address, phone number in order to plan out your trip to best of our abilities. Then, we create the detailed trip plan for you within 48 hours of your submitted request. Once the trip is planned out in details we kindly ask you to remit your payment. See “Payment” section for more information.
When CustomTrip asks you to remit your payment, we are obliged to provide in details all associated/expected costs for the Trip Plan, our terms and rules to payment methods, payment terms, and cancellation policy.
By using the Services, you consent to receive electronic communications from CustomTrip.These electronic communications may include notices about applicable fees and charges, transactional information and other information concerning or related to the CustomTrip services and your Customized Trip Plan request.These electronic communications are part of your relationship with CustomTrip. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.
As a Traveler, you agree that you will only complete your Trip Plan purchase via the CustomTrip link send to you via confidential and encrypted e-mail.
CONTRACTS BETWEEN TRAVEL COMPANIES AND TRAVELERS
The SP is not responsible and covers no liability for any contracts made between you (“The Traveller”) and a Travel Company, Booking Agency, Accommodation’ websites, or any other third-party involved. It is your decision whether or not to book your methods of transportation, accommodations and/or venues to visit, or any other activity you would be interested in participating throughout your trip by using our suggested links. We simply suggest and/or consult.
The SP is not involved in any contracts with Travel Agents, Travel Companies or Booking Companies. We have created affiliated accounts with specific booking websites with the sole purpose of receiving a few earnings from the total sale IF you (“The Traveller”) decide to follow our suggestions. The affiliated earnings are primarily used for website maintenance.
Any ads or finished trip packages you see on our site are created for affiliate marketing purposes.
THIRD PARTY CONTENT AND LINKS
Any content posted on our website via “third-party links” such as ads, finished trip products, travel packages are not created or owned by the SP. Customtrip.org does not take responsibility if there are inappropriate, inaccurate or any other misleading information on those posts offers and/or links.
The Site may contain links to other third-party Web sites or resources (“Third Party Sites”). You acknowledge and agree that the SP is not responsible or liable for: (i) the availability or accuracy of such Third Party Sites; or (ii) the content, advertising, or products on or available from such Third Party Sites. The inclusion of any link on the Site does not imply that we endorse the linked to Third-Party Site. Your use the links is at your own risk.
TERMS OF PAYMENT
LIMITATION OF LIABILITY
NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT, IN NO EVENT WILL THE SP BE/HAS A LIABILITY TO YOU FOR ANY ACTION OR CLAIM RELATED TO THE SERVICES PROVIDED UNDER THIS AGREEMENT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE OR ANY OTHER THEORY OF LIABILITY, EXCEED IN THE GREATER OF: (A) $100 OR (B) THE AGGREGATE AMOUNT OF SERVICE CHARGES ACTUALLY COLLECTED BY US FROM YOU FOR THE SERVICES TO WHICH THE LIABILITY RELATES DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE DETERMINATION OF SUCH LIABILITY.
You agree to defend, hold harmless and indemnify the SP from and against any and all losses, costs, expenses, damages or other liabilities incurred by the SP from and against any cost, liability, loss, damage, cause of action, claim, suit, proceeding, demand or action brought by a third party against the SP: (a) in connection with your use of the Services or purchasing of products, including, without limitation, any payment obligations incurred through use of the Services or purchasing of products; or (b) resulting from: (i) your use of the Site (ii) your decision to supply credit information via the Site, including personal financial information; (iii) any liability arising from the tax treatment of payments or any portion thereof; (iv) your dispute of or failure to pay any invoice or any other payment; and/or (v) your obligations to a Travel Company. Any such indemnification shall be conditioned on our: (a) notifying you in writing of any such claim, demand, action, cost, liability, loss or threat of any thereof; (b) cooperating with you in the defense or settlement thereof; and (c) allowing you to control such defense or settlement. We shall be entitled to participate in such defense through our own counsel at our own cost and expense. We reserve the right to report any wrongdoing of which we become aware of the applicable government agencies or otherwise.
Licenses, Site Access and Copyrights
Subject to and conditioned on compliance with this Agreement, the SP grants you a limited license to access and, if you are a Member, to use the Site internally for the purpose of ordering and receiving the Services available and authorized from the Site. You must not sell, copy, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, repost or otherwise use any content of this Site in any way for any public or commercial purpose without the prior written consent of the SP or the rights holder. You must not use any content of this Site on any other Web site or in a networked computer environment for any purpose except your own internal viewing. You will not attempt to reverse engineer or attempt to interfere with the operation of any part of this Site unless expressly permitted by law. The Site or any portion of the Site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose that is not expressly permitted by the SP.
Reservation of Rights
You are responsible for compliance with applicable local laws, keeping in mind that access to the contents of this Site may not be legal for or by certain persons or in certain countries
The law and jurisdiction of the Republic of Bulgaria will be applied if any of the above terms, conditions, rules, and agreements are misrepresented, wronged, misused, sold, recreated or any other illegal activity occurs.
This Agreement and all documents referenced herein constitute the entire agreement between you and the SP with respect to the subject matter hereof and supersedes all prior agreements between the parties as well as any conflicting or inconsistent terms in any Web site that link to or are linked from this Site.
GDPR /GENERAL DATA PROTECTION REGULATION/
According to the new law passed by the European Union Legislature and coming into effect on May 25th, 2018, the so called GDPR /General Data Protection Regulation/ we would like to inform you what kind of personal data the SP, which owns www.customtrip.org, will be collecting, for how long we will be keeping it and where it will be stored. Please note that we will not collect anything without written consent/your agreement from your part, as our client, and that you will always have the option, by informing us, to opt-out from having your personal data kept by us.
If you do decide to allow us to keep, store and use your personal data for the specific time period mentioned in the consent, but later change your mind and opt-out, you will receive an official e-mail by us confirming that we no longer keep your data. If the opt-out includes the e-mail address you have given us, we will immediately delete it from our data base once the opt-out confirmation is sent and you won’t receive anything else from us again unless we receive new authorization by you.
In order to be able to serve you as best we could, as travel consultants and trip planners, we collect the following information, for the time period mentioned, and in the following ways:
YOU HAVE THE RIGHT TO ACCESS YOUR STORED DATA AT ANY TIME AND/OR SEND US A REQUEST TO REMOVE IT!
PURCHASING OUR SERVICES
- Upon payment submitted by you, by initiating the purchase on our products page or by simply contacting us via email and/or social media channels, or by filling up our contact form, we ask that you allow us to collect:
- your FIRST and LAST name;
- email address;
- any information in regards to your trip /dates of travel, places to visit, venues to visit, possible accommodation you have chosen, methods of transportation preferred by you/;
- telephone number;
- payment method information /debit card, credit card, paypal/, and address where the payment method is registered IF the system asks you for such information. (at the moment we only work through PayPal so your payment is always secured)
We ask that you allow us to keep the following information for a period of 90 days:
- first and last name;
- email address;
- any information in regards to your planned trip as mentioned above;
- payment information
TIME PERIOD WE KEEP YOUR INFORMATION
This information will be securely stored and kept in our database and used ONLY if we need to issue a refund or if proper legal authorities seek it out. After the 90 days, your information will be permanently deleted and you will receive a confirmation email that your data has been deleted from our database.
THIRD PARTY USE OF INFORMATION
If a third party requests your information from us, such as legal authorities, you will be informed via email WHO , WHEN and for WHAT PURPOSE asked for your personal data. We will not distribute your personal data to any third parties without your written consent first. Once you have given us your consent, we will distribute ONLY the data they ask for and will provide you with the third party contact information, so that you can keep track on their activities in regards to your personal information/data.
INFORMATION COLLECTED FROM SOCIAL MEDIA
In order for us to continue to help you out with your travel plans as best as we can, and as your travel consultants and trip planners, we would like to inform you, and ask for your agreement, that when we do social media campaigns and/or make posts on social media networks /Facebook, Instagram and Twitter under name of customtrip2017/, we do receive general information of who has visited our social media profiles and we do use it for analyses and marketing purposes. We store this information for a period of 90 days, then we being to collect new one. The information we look for and we receive is the following:
- average percentage of people who have visited our social media profiles based on gender (ex: 40% male and 60% female)
- location (ex: New York, L.A.)
- day and time (ex: Monday at 5 PM most visits)
- age category: (ex: age group 25-34)
- if we do a targeted social media campaign we also receive information such as specific state and/or city (ex: most visits from Des Moines, Iowa)
- IP address
- Cookie IDs
- at times we also see your social media NAME/NICKNAME
- we never download, make copy or use any photos from your personal and/or professional profiles. If we want to feature you in our articles or use photos for reviews, you will receive an official email by us asking for your written consent to do so.
/we give you an inclusive list, but we DON’T always collect ALL of the information mentioned above/
INFORMATION COLLECTED FROM THE IN-SITE CHAT
- your name;
- your e-mail address;
We store chat information for no more than 24 hours and only use it to answer to any of your questions.
WE CARE FOR YOU
Your trust and confidence in us, as well as your personal security, is of paramount importance to us. While we would love to continue and work with you, and plan the best trips you have ever gone to, we will understand if you feel uncomfortable giving us permission for any of the above mentioned personal information and data that we collect.
We strive to minimize the personal data we collect from our clients, but today it is almost impossible to conduct business online without at least having the first and last name of the customer(s), valid email address, and/or receive payment information when an online purchase has been made.
